Refund & Cancellation Policy

This Refund & Cancellation Policy constitute a legally binding agreement governing all services provided by VV Research IP, a brand owned and operated under Vilasani Ventures LLP, a Limited Liability Partnership incorporated under the laws of India (hereinafter referred to as the "Company", "VV Research IP", "We", "Us", or "Our").

By accessing our website, communicating with us, executing an engagement, making payment, or availing any service, whether directly or indirectly, the client, user, customer, or entity ("Client", "You") expressly acknowledges, understands, and agrees to be bound by this Refund & Cancellation in their entirety.

This whole Refund & Cancellation Policy forms an integral part of the Terms & Conditions and shall be read harmoniously with them, along with all the other policies, rules, guidelines, etc. provided by the Company as and when made applicable accordingly.

If You do not agree to this Refund & Cancellation Policy, You must immediately discontinue use of all services.

This Refund & Cancellation Policy ("Policy") governs all payments made ONLY to VV Research IP for any service, engagement, subscription, monitoring service, filing, drafting, research, litigation support, or consultancy activity.

This whole Policy forms an integral part of the Terms & Conditions and shall be read harmoniously with them, along with all the other policies, rules, guidelines, etc. provided by the Company as and when made applicable accordingly.

All services provided by VV Research IP are customised, professional, knowledge-based, and effort-intensive.

Accordingly, all payments are non-refundable once work has commenced, unless expressly stated otherwise in a written agreement signed by an authorised representative of VV Research IP.

Commencement of work includes, but is not limited to:

1. Initial consultation or analysis,

2. Allocation of internal or vendor resources,

3. Drafting, searching, filing, or monitoring setup,

4. Communication with statutory authorities or third-party professionals.

In addition to the above mentioned cases, in general, ‘commencement’ shall mean when the Company:

1. Executes any service in favour of the concerned individual/client, without even receiving any compensation/amount/price for the same, or

2. Receives a certain amount/compensation/price by the concerned individual/client.

If need be, as and when required, the Company shall have the complete, sole, unilateral and unconditional right to decide the ‘commencement’ and the said decision shall not be refuted, denied, ignored or disputed by the concerned Client/individual respectively.

Cancellation requests must be made in writing to the Company’s official email, with clear indication of:

1. Order ID, and

2. Date of such order, and

3. Appropriate reasons for the same.

If cancellation is requested before commencement of work, VV Research IP may, at its sole discretion, consider a partial refund after deducting:

1. Administrative charges, and

2. Consultation fees, and

3. Transaction costs, and

4. Any other charges which the Company deems fit to deduct.

If cancellation is requested after commencement, no refund shall be issued under any circumstances.

Whether any order/service has been ‘commenced’ shall be solely decided by the Company only.

The following services are strictly non-refundable, irrespective of stages they are in and irrespective of Clause 4 of this Policy:

1. Patent, Trademark, Design, or Copyright filing & prosecution,

2. Government or statutory fees,

3. Searches, opinions, and reports,

4. Drawings, 3D modelling, and rendering,

5. Monitoring services once activated,

6. Monetization & licensing documentation,

7. Litigation support and coordination services.

8. Professional opinions, consultations, advisory charges and other charges of like nature.

Fees paid to the following entities shall be strictly are non-refundable:

1. Government authorities,

2. IP offices,

3. Courts,

4. Independent lawyers, agents, vendors, or consultants,

5. Any Quasi-judicial court.

VV Research IP shall not be responsible for refund of any third-party or statutory payments.

Please note that charges mentioned under Clause 6(a) and (b) above may be impossible to compute and communicate at the beginning of any Service provided by the Company, as most of them are subject to change or difficult to assess. Therefore, such charges shall be computed and communicated and charged accordingly after the commencement of such Services and shall be legally binding on the concerned Client respectively.

Delays caused by statutory authorities, courts, third-party professionals and vendors, or force majeure events do not entitle the Client to a refund.

Rejection, refusal, opposition, objection, or adverse outcome, due to any reason, shall not constitute deficiency of service and shall not give rise to any refund claim.

VV Research IP reserves the right to terminate services without refund in cases of:

1. Non-payment or delayed payment; or

2. Misrepresentation or concealment of facts, or

3. Illegal or unethical instructions, or

4. Abuse, harassment, or non-cooperation.

The Company shall have full discretion and sole authority to decide the reason(s) (and their sub-reasons and details) for such unilateral termination by the Company. The same shall be communicated to the concerned Client compulsorily. The Client shall bear no right to resume the said Service on their own accord.

Unauthorised chargebacks or payment disputes initiated without prior written communication shall be treated as material breach of contract.

In such cases, VV Research IP reserves the right to:

1. Suspend all services, or

2. Recover costs and damages, or

3. Pursue legal remedies, or

If any amount which is not due to the Company, still comes to the Company somehow, then it shall be treated as ‘miscellaneous’ amount. The Company shall wait a total of 30 days, during which the Company shall try its best to refund the same to its source. If such a source is still untraceable, then the Company shall have the right to keep the same. 

Any exception to this Policy must be:

1. Explicit, and

2. In writing, and

3. Signed by an authorised representative of VV Research IP

This Policy shall be governed by the laws of India. Courts of Haryana, India shall have exclusive jurisdiction.

If any provision is held invalid, the remainder shall remain enforceable. This Policy constitute the entire agreement and may be amended at Company discretion. Any amendments to this Privacy Policy shall be communicated to the Clients/concerned individuals and other connected individuals by the Company at an appropriate time through the Company’s official email.
